SOCIAL MEDIA CONTEST OFFICIAL RULES

BY ENTERING THIS CONTEST, AN ENTRANT IS INDICATING HIS/HER ACCEPTANCE
OF AND AGREEMENT TO BE BOUND BY THESE TERMS AND CONDITIONS.

1. Eligibility: This Contest is open only to those who complete entry requirements at https://www.facebook.com/hiddensecretsapp/posts/936264036721868?notif_id=1566428553556317&notif_t=page_post_reaction and who are 18 years of age or older at the date of entry. The Contest is open worldwide, and is void where prohibited by law. The Contest is subject to all applicable federal, state, and local laws and regulations. Void where prohibited.

2. Agreement to Rules: By participating, the Entrant (“You”) agree to be fully unconditionally bound by these Rules, and You represent and warrant that You meet the eligibility requirements. In addition, You agree to accept the decisions of Hidden Secrets Studios as final and binding as it relates to the content of this Contest.

3. Contest Period: Entries must be received by the 31st of August, 2019 by 8PM PST.

4. How to Enter: The Contest must be entered by submitting an entry at: https://www.facebook.com/hiddensecretsapp. The entry must fulfill all Contest requirements, as specified, to be eligible to win a prize. Multiple entries will be accepted as determined by [https://www.facebook.com/hiddensecretsapp/posts/936264036721868?notif_id=1566428553556317&notif_t=page_post_reaction]. Entries that are incomplete or do not adhere to the rules or specifications may be disqualified at the sole discretion of Hidden Secrets Studios. No responsibility can be accepted for entries not received for whatever reason.

5. Prizes: The Winner(s) of the Contest (the “Winner”) will receive a Custom Hidden Secrets T-Shirt and 2000 In-Game Gold Coins with a total approximate retail value USD$50. Actual/appraised value may differ at time of prize award. The Prize will not contain any clues or any means of providing Winner an advantage in the Hidden Secrets: Escape Through Time treasure hunt. The Prize is in no way related to, required, or instrumental in the Hidden Secrets Studios mobile application gameplay, and furthermore, the Prize will have no redeemable value in the Hidden Secrets Studios mobile application itself. The specifics of the prize shall be solely determined by Hidden Secrets Studios. No cash or other prize substitution shall be permitted except at Hidden Secrets Studios’ discretion. The prize is non-transferable. Hidden Secrets Studios will notify the winners when and where the prize is delivered. Hidden Secrets Studios is not responsible for inaccurate prize details supplied to any entrant by any third party connected with this Sweepstakes. Prizes are subject to availability and we reserve the right to substitute any prize with another of equivalent value without giving notice. Any and all prize-related expenses, including and without limitation any and all federal, state, provincial, and/or local taxes, shall be the sole responsibility of Winner. Acceptance of prize constitutes permission for Hidden Secrets Studios to use and publish Winner’s name, likeness, photograph, location and entry for purposes of advertising and trade without further compensation, unless prohibited by law.

6. Odds: The odds of winning depend on the number of eligible entries received.

7. Winner Selection and Notification: Winner will be selected by the Hidden Secrets community under the supervision of Hidden Secrets Studios. Winners will be chosen by the top three entries with the most likes. The winner will be notified by direct message on Facebook as well as publicly announced within 28 days of the closing date. If the winner cannot be contacted or does not claim the prize within 14 days of notification, we reserve the right to withdraw the prize from the winner and pick a replacement winner. Hidden Secrets Studios shall have no liability for Winner’s failure to receive notices from Hidden Secrets Studios. If Winner cannot be contacted, is ineligible, fails to claim the prize within 14 days from the time award notification was sent, or fails to timely return a completed and executed declaration and release as required, the prize may be forfeited and an alternate Winner selected. Hidden Secrets Studios’ decision in respect of all matters to do with the Contest will be final and no correspondence will be entered into. Receipt by Winner of the prize offered in this Contest is conditioned upon compliance with any and all federal, state, and local laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY WINNER AT HIDDEN SECRETS STUDIOS‘ SOLE DISCRETION) WILL RESULT IN WINNER’S DISQUALIFICATION AS WINNER OF THE CONTEST, AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.

8. Rights Granted by You: By entering this Contest, You understand and agree that Hidden Secrets Studios, anyone acting on behalf of Hidden Secrets Studios, and Hidden Secrets Studios’ licensees, successors, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the World, without limitation, your entry, name, portrait, picture, voice, likeness, image, statements about the Sweepstakes, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes without any further compensation, notice, review, or consent.

9. Terms & Conditions: Hidden Secrets Studios reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Contest. Hidden Secrets Studios reserves the right, in its sole discretion, to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Contest or violates these Terms & Conditions. Hidden Secrets Studios has the right, in its sole discretion, to maintain the integrity of the Contest, to void votes for any reason. Any attempt by an entrant to deliberately damage any website or undermine the legitimate operation of the Contest may be a violation of criminal and civil laws. Should such attempt be made, Hidden Secrets Studios reserves the right to seek damages to the fullest extent permitted by law.

10. Limitation of Liability: By entering, You agree to release and hold harmless Hidden Secrets Studios and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) such entrant’s participation in the Contest and/or his/her acceptance, possession, participation, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; (v) electronic or human error in the administration of the Promotion or the processing of entries.

11. Disputes: THIS CONTEST IS GOVERNED BY THE LAWS OF NEW ZEALAND AND ANY DISPUTES WILL BE SUBJECT TO THE EXCLUSIVE JURISDICTION OF THE COURTS OF NEW ZEALAND, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Contest, participant agrees that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Contest, shall be resolved individually, without resort to any form of class action. Any dispute or difference arising out of or in connection with this Contest that cannot be resolved individually shall be referred to and finally resolved by binding arbitration in New Zealand in accordance with New Zealand law and the current Arbitration Protocol of the Arbitrators' and Mediators' Institute of New Zealand Inc. The arbitration shall be by one arbitrator to be agreed upon by the parties and if they should fail to agree within twenty-one (21) days from the date upon which the dispute arises then to be appointed by the President of the Arbitrators' and Mediators' Institute of New Zealand Inc. Further, in any such dispute, under no circumstances shall participant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than participant’s actual out-of-pocket expenses (i.e. costs associated with entering this Contest). Participant further waives all rights to have damages multiplied or increased.

16. Complete Release of Facebook: By entering and participating, entrant agrees to hold harmless, defend and indemnify Facebook from and against any and all claims, demands, liability, damages or causes of action (however named or described), losses, costs or expenses, with respect to or arising out of or related to (i) entrant’s participation in the Contest, or (ii) entrant’s participation in any Prize related activities, acceptance of a Prize and/or use or misuse of a Prize (including, without limitation, any property loss, damage, personal injury or death caused to any person(s).
